have you heard any words from fbi, law enforcement authorities on future briefings? >> well, there's going to be one in about two hours up in boston i think is the current plan. it wasn't clear if it was going to be 8:30 or 9:30 eastern. but now they're settling on 9:30. i guess you can watch what they say, but you can also watch what they do. the fact this happened in boston, that there was, you know, no obvious federal crime. but the fbi is leading the investigation says it all. because the fbi automatically has the lead in any attack that is considered to be terrorism. so that's -- that really tells you everything you need to know. >> all right. our thanks to chuck todd and pete williams. >> thanks, guys. >> we'll be getting updates throughout the morning. >>> up next, we'll hear from an e.r. doctor who treated some of the victims in yesterday's attack. >>> congressman michael mccullough will be joining us. "morning joe" will be right back from boston. everybody has different investment objectives, ideas, goals, appetite for risk. you can't say 'one size fits all'

there's going to be people saying this is my old brother-in-law and he's no good. there's going to be a lot of false starts on it. look, if you're a person on that video and you're not a bomber, you should be calling the fbi and saying, hey, i'm just a witness. you have the wrong guy. i wouldn't count on that happening. if that was the case, you should be calling yourself and you would be a witness. there's going to be false positives but all the people that get identified, one of those people is going to be -- two of those people is going to be white hat and dark hat and then it's going to transpire. the local police will get involved, state troopers, the police around the world, intelligence agencies. >> and it goes on and on. don clark, you were head of fbi field operations. tonight what are they bracing for? i'm sure they are banking many calls. what is the call that you'd be hoping to get? >> well, the call that you would be hoping to get is that some good, faithful law enforcement agent happened to pick up a person with this description, whether it's in a car

most americans think that's already the law. a few minutes ago, 90% of democrats in the senate voted for that idea. but it's not going to happen because 90% of republicans in the senate just voted against that idea. the gun lobby and its allies willfully lied about the bill. they claimed that it would create some sort of big brother gun registry. even though the bill did the opposite. this legislation in fact outlawed any registry, plain and simple, right there in the text. but that didn't matter. and unfortunately, spreading untruths about this legislation served the purpose because those lies upset an intense minority of gun owners and that in turn intimidated a lot of senators. there were no coherent arguments as to why we wouldn't do this. it came down to politics. the worry that that vocal minority of gun owners would come after them in future elections. they worried that the gun lobby would spend a lot of money and paint them as anti-second amendment. obviously a lot of republicans had that fear but democrats had that fear

it's a matter for law enforcement. now on the question of the public safety exception. it is not necessary that the individual be designated an enemy combatant in order for him to be questioned without giving him miranda warnings, the exception emanates from a supreme court decision in the early '80s, called new york versus quarrels. the criminal suspect in that situation was not a terrorist, he was not part of any enemy force. he was arrested in a grocery store in queens. and the police asked him where is the loaded gun. he had a gun with him. they couldn't find it. and for public safety reasons, they needed to find the loaded weapon quickly. and they asked him the questions without mirandaizing him. so the public safety exception is domestic in nature. so it's completely unnecessary to call him an enemy combatant in the first place. >> they had a lot of guns, and this is part of the investigation. how do two brothers in cambridge, mass, get ahold of all of this weaponry, and create these bombs? now low-level, low-tech bombs, be that they were. can they do that all wit
